This privacy policy sets out how The New Black Coffee (UK) Holdings Limited (Trading as “The New Black Coffee” and referred to in this document as “The New Black”) uses and protects any information that you give The New Black when you use our website (www.thenewblack.coffee) or The New Black mobile application on either iOS or Android.

The New Black is committed to ensuring that your privacy is protected. Should we ask you for PII (Personally Identifiable Information) when using this website or our mobile app, then you can be assured that it will only be used in accordance with this privacy statement.

The New Black may change this policy from time to time by updating this page. You should check this page from time to time to ensure that you are happy with any changes. If you have registered an email address with The New Black we will notify you of the changes by sending you an email. This policy is effective from 17/05/2018.

What we collect

We may collect the following information:

  • First name and last name.
  • Contact information including email address and telephone number.
  • Information about how you have used our Mobile App and Website for example we keep a record of all of your orders through our app, all of the top ups you have made on your account and other actions you take when using our services however if you request data to be removed for example you change your name or email address we will remove this data and will not keep a record of the previous data.
  • Demographic information such as postcode, preferences and interests, we use third party services such as Google Analytics and Google Adwords to monitor the performance of our services and marketing. We will only allow the use of these if you accept the cookies which allow us to gather this data.
  • Other information relevant to customer surveys you have filled out and given us permission to use.
  • Device information of the device you use to access our services such as a mobile phone or computer.
  • Technical data such as your IP address.
  • Transactional information when you make a purchase in one of our stores.

What we do with the information we gather

We require this information to understand your requirements and provide you with a better service, and in particular for the following reasons:

  • Internal record keeping.
  • We may use some information such as your email address as a login credential. Providing us with this email address does not give permission for us to contact you for marketing purposes unless you have specified that you would. We may use this email address to contact you for account related purposes for example if you have forgotten your password or an issue has occurred with a transaction you have made.
  • We may use the information to improve our products and services.
  • We may periodically send promotional emails about new products, special offers or other information which we think you may find interesting using the email address which you have provided if you have consented to receiving email updates from The New Black.
  • From time to time, we may also use your information to contact you for market research purposes. We may contact you by email, or telephone. We may use the information to customise the website or mobile application according to your interests. We will only contact you in this way if you have consented to us that we may do so.
  • We may make automated decisions based on the information you provide, we don’t allow robots to make big decisions for you such as charging a payment method without your explicit consent however we may make decisions based on information we hold about you such as which outlets your order your coffee from and which drinks your order most often.
  • We may use transactional data collected when you use a payment method in one of outlets to see customer behaviour, for example how often a particular debit/credit card is used and what type of products it is used to buy. We may also use this information to create a link between your online presence with the new black and your in person payment activity.

Where your data is stored

The New Black stores all of the first party data that we collect from you on secure servers in the United Kingdom. Data is also stored by third party services which we use such as Stripe who we use for payment processing, this type of data may be stored outside of the EEA.

How long we will keep you data

We only hold your information for as long as we do the activities we told you about or have a valid reason to keep it. Data collected using Google Services however will only be stored for 14 months as we view this as non-essential data.

Security

We are committed to ensuring that your information is secure. In order to prevent unauthorised access or disclosure, we have put in place suitable physical, electronic and managerial procedures to safeguard and secure the information we collect online.

Our website is scanned on a regular basis for security holes and known vulnerabilities in order to make your visit to our site as safe as possible. We also use regular Malware Scanning.

Your personal information is contained behind secured networks and is only accessible by a limited number of persons who have special access rights to such systems, and are required to keep the information confidential. In addition, all sensitive/credit information you supply is encrypted via Secure Socket Layer (SSL) technology.

We implement a variety of security measures when a user places an order, enters, submits, or accesses their information to maintain the safety of your personal information.

All credit/debit transactions are processed through a gateway provider and are not stored or processed on our servers. We use Stripe to provide these services and all data we send to them is encrypted before sending.

We have taken precautions such as encrypting any passwords that you may use with us.

In the event of us detecting a data breach we will notify you within 72 hours.

Controlling your personal information

You may choose to restrict the collection or use of your personal information in the following ways:

  • Whenever you are asked to fill in a form on the website, look for the box that you can check to indicate that you want to receive marketing email updates from The New Black.
  • If you have previously agreed to us using your personal information for direct marketing purposes, you may change your mind at any time by writing to or emailing us at info@thenewblack.coffee or using the unsubscribe hyperlink at the bottom of the direct marketing you have received by email.
  • If you are unhappy with the way that The New Black has handled your data you are free to complain to the appropriate regulating body.

THE NEW BLACK MOBILE APP TERMS AND CONDITIONS

The terms and conditions set out below are created by the The New Black Coffee (UK) Holdings Limited (Trading as “The New Black Coffee” and referred to in this document as “The New Black”) and refer to the use of our mobile app available on iOS and Android. For information relating to the use of your data when you use the app please refer to our Privacy policy.

The New Black accounts are issued by The New Black Coffee (UK) Holdings Limited, 10 Philpot Lane, London, EC3M 8AA.

‘Top Up Account’ - A Top Up Account is a digital pre-paid account which may be used to pay for goods in The New Black outlets in the UK only.

The account is only for use of internet transactions in The New Black Mobile App and The New Black Website.

The account is not covered by the Payment Services Regulations 2009 or the Electronic Money Regulations 2011. Adding credit to your top up account is the purchase of a means of payment, it is not a deposit. You will not earn interest on the balance of the account.

The balance on the account is valid for a period of 12 months from the date of purchase. Your account balance will cease to be valid 12 months from the date of purchase. The New Black may choose to extend this period but is under no obligation to do so.

The maximum value that may be added in one transaction is £100.

Additional funds added on to the account are valid for a 12 month period commencing on the date of purchase of the additional funds. The New Black may choose to extend this period but is under no obligation to do so.

The balance on the account is used strictly in chronological order with the oldest funds loaded to the account used first.

We may ask for evidence of your identity before we issue a credit to your account. We do this to prevent fraud and money laundering.

If you fail to provide us with the requested evidence of identity, or if at our sole discretion we are not satisfied with the evidence you have presented to us, we reserve the right not to issue credit to you. Our decision shall be final, and we shall not be obliged to provide a reason for refusing to issue credit to your account.

The purchase of credit or use of the account will indicate to us that you consent to the checks described in this agreement being undertaken.

Credit added to a specific account is for use only by that account and is not transferrable.

We will be entitled to assume that a transaction is authorised by anybody placing an order with that account.

Once we have received your instruction to proceed with the transaction, the transaction cannot be stopped or revoked.

The account may only be used for full payment of a transaction. We may in some instances allow partial payment where the rest is paid in full using another payment method for in stance with a card reader in store however we are not obliged to do so.

A Top up account is not linked to a bank account and is not a cheque guarantee card, charge card or credit card, nor does it attract interest on the balance, nor may it be used as evidence of identity.

Use of a Top up account may be restricted without notice if suspicious, fraudulent or illegal activities are identified or suspected, if we believe you have not complied with these terms and conditions, or in the event of exceptional circumstances which prohibit the normal operation of the top up account.

Only the person who has purchased the credit will be able to request a refund, subject to proof of identity, production of the original receipt and the return of the credit. Any refund will be made by returning funds to the source of the original credit purchase; for example if the credit was purchased using a credit card, funds will be returned to that credit card.

The purchaser of the credit is entitled to a 14-day ‘cooling off’ period. Should you wish to cancel the credit within that period you need to return to a The New Black outlet in the UK with your original sales receipt within 14 days of purchase and a full refund will be made, providing the credit and any incentive issued alongside that credit has not been used. You can also telephone +442030514696 to cancel the credit within the 14 days.

You are responsible for keeping your Top Up Account and its details safe. This means you must take all reasonable steps to avoid the loss, theft or misuse of the Top Up Account or details. Do not disclose the account details to anyone except where necessary to complete a transaction.

If access to the account has been lost for any reason the original purchaser of the credit will have to notify The New Black, the account can then be frozen until they are able to visit The New Black in person to have the account reset. Proof of identity and/or payment method may be required.

If after the account has been frozen for 72 hours no successful attempt to visit The New Black on Philpot Lane has been made the account will once again be able to be used.

This account may be loaded with and redeemed for the value of Pounds Sterling only.

The New Black is not liable for any losses incurred by the purchase of credit.

Once an order has been placed using The New Black App and paid for using credit topped up on to the account this order can only be withdrawn in person by requesting a cancellation at the outlet before the order has begun preparing. If the is order already being prepared then the order can be cancelled but the credit will not be refunded. If a user fails to collect their order within an appropriate amount of time of the order being marked as ready the order will be disposed of and the order will be cancelled without refunding the credit.

Users can track the status of their order so that they know when it is ready to be collected in peak condition. If a user fails to collect the order whilst it is at peak condition the user must accept the order as it is upon their arrival.

Redemption of credit is limited to the opening times of the outlet at which you wish to redeem it.

The New Black mobile app may at times issue different types of credits in addition to the value held on The Top Up account such as credits for a free drink. These types of credit may be restricted to a specific type of product and any promotion under which these types of credits are issued may be withdrawn at any time. These types of credits have no monetary value.

The mobile app and all materials, text, code, content, software, graphics, photographs, illustrations, artwork, formats, files, devices and links contained in it or linked to it (hereinafter “Content”) are protected by copyrights, trademarks and other intellectual property rights owned by or licensed to, The New Black Coffee (UK) Holdings Limited.

Mobile app users acknowledge that The New Black does not control the transfer of data over telecommunication facilities including the Internet. Therefore, The New Black warns visitors against any potential risk involved by the use of the Internet in this respect.

The New Black reserves the right to withdraw, amend or replace these terms and conditions without prior notification, however we will endeavour to update our users on changes to these terms and conditions when possible.

THE NEW BLACK LOYALTY CARD TERMS AND CONDITIONS

The terms and conditions set out below are created by the The New Black Coffee (UK) Holdings Limited (Trading as “The New Black Coffee” and referred to in this document as “The New Black”) and refer to the use of loyalty card. For information relating to the use of your data when you use the loyalty card please refer to our Privacy policy.

Loyalty Cards are issued by The New Black Coffee (UK) Holdings Limited, 10 Philpot Lane, London, EC3M 8AA.

‘Loyalty Card’ - A loyalty card is a reward scheme in place in The New Black at The New Black outlets in the UK.

The Loyalty Card has no monetary value.

The Loyalty Card may not be used in conjunction with other loyalty schemes or promotions.

The Loyalty Card may not be used in conjunction with The New Black mobile app which has a separate reward scheme.

The Loyalty Card is not for use for mail order, telephone order or internet transactions.

The Loyalty Card can be issued upon request at the time of purchase only and a stamp will be awarded to the card for each valid purchase. The card must then be presented at the time of purchase on each subsequent qualifying purchase to gain additional stamps.

Upon accruing 10 stamps this Loyalty Card may then be redeemed for a complimentary coffee or tea in-store and must be shown at the time of purchase before the transaction has been completed.

The New Black may limit the coffees and teas that the Loyalty Card may be redeemed against.

A Loyalty card must be used by the person to whom it was issued.

Stamps accrued on a loyalty card are non-transferrable.

A Loyalty card may only be redeemed once and will be retained by The New Black, failure to comply will result in refusal of a complimentary coffee or tea.

A Loyalty Card is not linked to a bank account and is not a cheque guarantee card, charge card or credit card, nor does it attract interest on the balance, nor may it be used as evidence of identity.

Use of a Loyalty Card may be restricted without notice if suspicious, fraudulent or illegal activities are identified or suspected, if we believe you have not complied with these terms and conditions, or in the event of exceptional circumstances which prohibit the normal operation of the Loyalty Card.

You are responsible for keeping your Loyalty Card safe. This means you must take all reasonable steps to avoid the loss, theft or misuse of the Loyalty Card. Any accrued stamps will not be reissued if the Loyalty Card is lost or stolen.

The New Black is not liable for any losses incurred by the use of the Loyalty Card.
